Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Haru, operated by Haru Care (“we”, “us”), including websites at harucare.ca and app.harucare.ca and our mobile applications (collectively, the “Service”).
By creating an account or using Haru, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Haru helps postpartum families log and review care and recovery-related information and share that history with caregivers they invite. Features may change as we improve the product.
2. Not medical advice
Haru is a consumer software companion. It is not a medical device, does not diagnose or treat any condition, and does not replace professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with questions about your or your baby’s health. If you think you may have a medical emergency, call emergency services immediately.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for the accuracy of information you provide about infants and other family members in your care.
4. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly of unauthorized use at support@harucare.ca.
5. Household sharing
When you invite others to your family, you authorize them to access care data associated with that household according to the product’s permissions. You are responsible for inviting only people you trust and for complying with applicable laws when sharing information about others (including infants).
6. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Attempt to access other users’ data without authorization
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer or scrape the Service except where allowed by law
- Misrepresent your identity or affiliation
7. Your content
You retain ownership of the content you submit. You grant us a limited license to host, store, process, and display that content solely to operate and improve the Service for you and caregivers you authorize.
8. Intellectual property
Haru, our branding, and the Service software are owned by Haru Care or its licensors. These Terms do not grant you any right to use our trademarks except as needed to use the Service.
9. Third-party services
The Service relies on third-party platforms (including Google Firebase and Google Sign-In). Your use of those services may also be subject to their terms and policies.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or that care data will never be lost.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARU CARE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF CAD $50 OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
12. Indemnity
You will defend and indemnify Haru Care against claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
13. Termination
You may stop using Haru at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by nature should survive (including disclaimers and limitations) will survive termination.
14. Changes
We may update these Terms by posting a revised version on this page. If changes are material, we will take reasonable steps to notify you (for example in-product notice). Continued use after the effective date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules. Courts in Ontario will have exclusive jurisdiction, subject to any non-waivable consumer protections where you live.
